The Terms and Conditions listed below govern the access and use of our website and mobile phone application that enable you to manage your facilities maintenance, repairs, and cost tracking operations ("Service(s)"). In this Terms of Service the terms “we”, “us”, “our” refer to Skoolafix Limited ("Ariifu") and “you”, “your” refer to any person who accesses and/or uses the Service. It is important that you understand that access and use of the Service is conditional on your acceptance of these Terms and Conditions.
By registering to use and/or using the Service in any manner, You, just as if You had done so in writing, (i) acknowledge that You have read and understood the Terms, (ii) represent and warrant that You are at least eighteen (18) years of age, and if applicable, have the authority to enter into these Terms on behalf of any person or entity for whom You are accessing or using the Services, and (iii) agree to these Terms and all other rules, policies, and procedures that may be published on the Website or App from time to time, each of which are incorporated into these Terms and each of which may be updated without notice to you. Certain of the Services may be subject to additional terms and conditions specified by us from time to time; Your use of such Services is subject to those additional terms and conditions, which are incorporated into these Terms by reference. These Terms are binding upon any use of the Services, including by Subscribers and Invited Users, and apply to You from the time that Ariifu provides You with access to the Services.
The Services will evolve over time based on user feedback. Ariifu may amend these Terms from time to time. You may be required to click “accept” or “agree” to show your consent to an amended version of these Terms.
You are solely responsible for ensuring that these Terms are in compliance with all laws, rules and regulations applicable to you. The right to access the Services is revoked where these Terms or use of the Services is prohibited or to the extent offering, sale or provision of the Services conflicts with any applicable law, rule or regulation.
1. User Accounts and Security
You must provide accurate, complete, and current information when creating an account on Ariifu. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use or security breaches.
2. License to Use
We grant you a limited, non-exclusive, non-transferable license to use the Service solely for educational and school administrative purposes in accordance with these Terms. You may not reverse engineer, copy, resell, or misuse the platform or database connections.
3. Data Privacy & Ownership
The school organization remains the sole owner and data controller of its own School Data (including budget figures, repair history, and campus details). We process data to provide the requested services and do not use personal student/staff data for unauthorized profiling. Both parties agree to handle personal data in accordance with applicable data protection regulations.
4. Payment Terms & Subscription Cycles
Fees for the Service are based on the agreed subscription plan (Monthly, Termly, or Annual campus rates). Invoices are generated at the start of each billing cycle, synchronized with the school calendar. All prices are subject to local taxes.
5. Limitation of Liability
The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Ariifu (Skoolafix Limited) shall not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use the Service.
6. Termination of Access
We reserve the right to suspend or terminate your account for breach of these Terms, including failure to pay subscription fees, providing false information, or unauthorized use of the platform.
7. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Kenya. Any disputes arising from these terms will be resolved exclusively in courts of competent jurisdiction in Kenya.
